These Terms of Use (these "Terms") constitute a legally binding agreement between you and the operator of the website escortfox.com, governing your access to and use of the Website (as defined below).   • "we", "us" and "our" refer to the operator of the Website;
  • "Website" means the website escortfox.com, together with its subdomains, applications and related services;
  • "you" and "your" refer to any person who accesses or uses the Website, whether or not a Member.

3.2 For the avoidance of doubt, you acknowledge and agree that:

  1. we permit only adult individuals to advertise their time and companionship to other adult individuals;
  2. we operate an advertising venue only; we do not provide any booking, escort, dating, matchmaking or introduction service, and we do not arrange, schedule, procure or facilitate any meeting between users of the Website;
  3. each Listing is created and published by the Advertiser concerned, who bears sole responsibility therefor; we act solely as a hosting service in respect of Content provided by Advertisers and do not author, endorse or verify any Listing, nor make any representation or warranty as to its accuracy or completeness;
  4. Advertisers are independent individuals or undertakings acting on their own account; nothing in these Terms or in the operation of the Website shall be construed as creating any employment, agency, partnership or joint-venture relationship between us and any Advertiser or user, and we exercise no direction or control over, and assume no responsibility for, the acts or omissions of any Advertiser or user;
  5. any price, rate or amount indicated in a Listing relates solely to the Advertiser's time and companionship and to nothing else, and shall not be presented, offered or construed as consideration for any specific service, act or outcome;
  6. our sole source of revenue is the sale of advertising products; we do not mediate, broker, negotiate or derive any benefit from any transaction between Advertisers and users of the Website, and we take no commission, share or percentage of any arrangement concluded between them; and
  7. any arrangement, communication or conduct occurring between users of the Website constitutes the free and private choice of consenting adults and a matter strictly between them; we are not a party to, and assume no responsibility for, any agreement arising from the free choices of users communicating through the Website.

4. Eligibility and Access

4.1 Access to the Website is restricted to persons who are 18 years of age or older, or who have attained the age of majority in the jurisdiction from which the Website is accessed, whichever is higher.

4.2 If we discover, or have reasonable grounds to suspect, that you do not satisfy the foregoing age requirement, we reserve the right to suspend or terminate your account forthwith and without notice. 6. Advertiser Warranties: Age Verification and Consent

6.1 Advertisers, and all persons publishing Content on the Website, are subject to additional requirements designed to protect minors and to prevent trafficking and the publication of non-consensual material. By publishing any Listing or other Content, you represent, warrant and undertake that:

  1. every person depicted, described or referred to in the Content is an adult aged 18 years or over, both at the time the Content was created and at the time of its publication;
  2. you have obtained the informed, written and verifiable consent of every person depicted to the creation of the Content and to its publication on the Website, and no such consent has been withdrawn;
  3. you are able to produce, upon our request, valid government-issued identification establishing the age and identity of every person depicted, together with the consents referred to above, and you shall retain such records for so long as the Content remains published and for any longer period required by applicable law; and

  2. remove any Member profile (including all published Content) or other material which, at our sole discretion, may be inappropriate, or which we suspect to be illegal, to expose us to liability or to violate these Terms, or where we are required to do so by law;
  3. issue Members with written warnings, and take such further measures as we deem appropriate where such warnings are not heeded;
  4. suspend or terminate a Member's access to the Members' areas of the Website, or a Member's account, at any time and without notice;
  5. inform the appropriate authorities of, and provide them with information regarding, any suspected illegal activity; or
  6. institute legal proceedings against any Member or other user of the Website in respect of any breach of these Terms or any illegal or suspected illegal activity.

11.2 We shall determine the appropriate measure on a case-by-case basis. You acknowledge that we may be required by law or regulation to access, monitor, store or copy material sent by or to Members, without further notice to you. 12. Representations, Warranties and Indemnity

12.1 You represent and warrant that: (a) all information and details provided by you to us, including upon registration as a Member, are true, accurate and up to date in all respects and at all times; and (b) you shall comply with these Terms, including, without limitation, the eligibility requirements and the restrictions relating to Content and acceptable use set out herein.

14.2 If you are a consumer in the European Economic Area, the United Kingdom or Switzerland, you may have a statutory right to withdraw from a distance contract within a defined period. 18.6 These Terms are drawn up in the English language; where we provide a translation, the English version shall prevail in the event of any conflict or inconsistency.
